Though not surprising to me, it is a matter of regret to note that DoT is taking the very same negative attitude towards the absorbed BSNL employees and pensioners. Some officersin Sanchar Bhavan have a wrong notion that BSNL staff and retirees get higher Pay and Pension than their counter-parts in central services with same length of service. The fact is that whatever the benefit derived from corporatization in 2000 has disappeared soon by way of reduced quantum of dearness allowance all these 18 years.

Central Govt pensioners got 50% DA merged from April 2004; BSNL Pensioners got that benefit only from 10-6-2013.

Central Govt pensioners got pension revision from January 2006; BSNL Pensioners got pension revision from January 2007.

Central govt. pensioners got pension revision again from 2016; BSNL pensioners are still waiting for it.

Central Govt pensioners got the benefit of Third option with concordance Table; BSNL pensioners are denied that .

All benefits from corporatization have disappeared in the thin air.

Amount drawn as pay or pension cannot be basis for taking policy decisions on revision.A DDG is getting higher Pay than his Director or AGM.Does it mean that DDG should not get pay revision?A retired DDG is getting higher amount as pension than those retired as Director or AGM.Should that retired DDG not get pension revision? Anybody should get the pay revision or pension revision as per the rule of the land. There are judgements from the Apex Court.

Few weeks back one Director in Sanchar Bhavan wrote a letter asking CMD BSNL to tell how BSNL is going to raise funds to meet the expenses for pay revision.When brought the matter to notice of the Secretary Telecom, it was propagated that “madam was angry over it and fired the Director and the letter would be withdrawn”. Nothing was withdrawn.

Now, a much worse letter is gone from Sanchar Bhavan to CMD BSNL.

With whose permission such letters are going?

Who takes decisions on such important matters?

It is high time for the Minister to intervene.

Minister should not allow any particular officer in his ministry spoil the future of lakhs of people serving and retired.

BSNL staff unions and Pensioners organizations should come out of any illusion about ‘noble hearts’ in Sanchar Bhavan .

Good number of employees retire one day before their Date of Next Increment (DNI). Though they completed one year after previous Increment date they do not get the benefit of that one year. Some people have gone to the Court and won the case. Appeals filed by government also have been rejected by Supreme court of India. Thus, the case has reached the finality.

CHQ has demanded a general order so that all affected pensioners shall get the benefit.

In the special meeting of Cuddalore (Tamilnadu) branch of AIBSNLPWA held on 27-12-2018, Com. N Sivanandan of Ernakulam was honoured. Com. Sivanandan, an active member of our Association spends his entire pension amount every month to help the victims of Endosulfan disaster in Kasargod district of Kerala.

Background:

During 1976-2000 the Plantation Corporation of Kerala sprayed poisonous Endosulfan insecticide on the cashew plantations of Kasargod area. The poison affected people of the area. Hundreds died. Many more are living unable to move out. [See the picture of one of them here under.]


The government, of coruse, is helping the victims. That is not enough. Hence many NGOs and individuals are helping them. Com. N Sivanandan is one amongst them.

Cuddalore branch invited Com. Sivanandan to their meeting. He attended it on 27-12-2018, along with Com. T P George, Circle Secretary of Kerala. In the said meeting Com. Sivanandan gave away a small gift packet to a poor woman.

We are proud of noble hearted Com. Sivanandan.

TODAY, THE KARNATAKA CEC MEETING WAS HELD IN BANGALORE. COM. P GANGADHARA RAO, CIRCLE PRESIDENT HITHERTO RESIGNED FROM THE POST CONSEQUENT TO HIS ELECTION AS OUR GS. SENIOR LEADER COM. VIRUPAKSHAIAH HAS BEEN ELECTED AS THE CIRCLE PRESIDENT IN HIS PLACE. COM SHREEDHAR OF BELLARY IS ELECTED AS VICE PRESIDENT IN THE PLACE OF COM. VIRUPAKSHAIAH, VP TILL THE DAY.

The District Conference of Bangalore SSA was held today. More than 550 members participated. Newly elected CHQ office bearers from Karnataka - Com. P Gangadhara Rao GS, Com. G Babu VP and Com. Radhakrishna, AGS - were felicitated on the occasion.

Comrades K Ranganayakulu, R Janrdhana Rao and Deepak are elected as District President, District Secretary and Treasurer respectively.

Mother in Law of Com. D Gopalakrishnan expired today. She was 93. The funeral will take place in a village near Guduvancherry, outskirts of Chennai city tomorrow on 28-12-2018 after arrival of some relatives from other places.

According to the notification issued by Pr. CCA Mumbai, the Comprehensive Pension Management System will be launched by Honourable Prime Minister of India on 29-12-2018.

Dear Comrades,

The Comprehensive Pension Management System (CPMS) is being inaugurated formally on 29-12-2018. CCAs are organizing some function in every Circle in the afternoon of 29, December 2018. Our leaders are called upon to attend the function, understand the system properly to enable them help the pensioners in future.

When a new system is introduced, there will be some teething trouble. We should point out the difficulties.

There is lot of complaint that even now many Post Offices are not crediting the enhanced IDA promptly. When CPMS is in operative, the CCAs will be crediting the pension and DA etc directly to the account of the pensioners. So, there may not be any delay in getting IDA, provided the CCA office is efficient.

Pensioners will receive their pension from the Bank or the Post Office as the case is now.

We are happy to note that a new branch has been formed at Bareilly, in UP west in a meeting held on 26-12-2018. Com. Kailsah Gautam (CS) and Com. R C Sharma (Circle Vice President) attended the meeting and explained the various issues. In 1990, the new cadre of Phone Mechanic was introduced.Gr. D officials, on qualifying in the departmental examination and completion of due training were promoted to the PM cadre. In Tamilnadu circle, for want of vacancies some of such officials could not be given the promotion. As decided in JCM DC they were temporarily posted as Linemen and promoted to PM later on. The pay drawn in LM post was taken while fixing their pay in PM cadre and subsequently in the pension also. But, recently the Pr. CCA of Tamilnadu circle arbitrarily reduced their Last Pay Drawn and Pension. CHQ has taken up the case.The letter from CHQ is attached hereunder.

The All India conference of BSNLEU held at Mysuru, Karnataka has concluded electing unanimously Com. Animesh Mitra of West Bengal as President, Com. P Abhimanyu of Pondicherry as General Secretary and Com. Gakul Borah of Assam as the Treasurer.

We congratulate them. We hope that they will pursue the resolution passed by their Ghaziabad CEC meeting demanding pension revision of BSNL retirees at par with other central service pensioners covered by CCS Pension rule 1972 without waiting for wage revision of serving staff in BSNL.

PENSIONERS’ DAY: 2018

On 17.12.1982, the Supreme Court of India pronounced its landmark judgement in D S Nakara vs. GOI case. A Bench of SCI headed by the then Chief Justice Y V Chandrachud, J.D A Desai, J. O Chinnappa Reddy, J. V D Tulzapurkar and J. Bahrul Islam gave the classic judgement which is relevant even today. The judgement tells a lot beyond the particular issue,because Late Shri H D Shourie raised many basic issues concerning pension in their Affidavit.The Judgement said:

1) Pension is neither a bounty nor a grace
2) Pension is not an ex gratia payment
3) Pension is a social welfare measure
4) It creates a vested right subject to 1972 rules which is statutory in character
5) A pension scheme must enable the pensioner live from want and with decency and self respect…

EFFECT OF THE CASE:

a) Till then there was no pension revision in central services. From 1986 onwards the pension revision came into effect.

b) While Sri Rajiv Gandhi was the prime minister (1984-89) a new Ministry of Personnel was created to take care of pensioners.
c) A new Department of Pension and Pensioners’ Welfare was created

d) Standing Committing of Voluntary Agencies was introduced to discuss the pension related issues of central service staff. Now SCOVA is not effective.

e) Pension Adalat was introduced.

f) Administrative Tribunals were started to quickly hear and dispose the cases of central govt employees and pensioners, though it failed in recent time.

g) Fifth CPC gave ‘complete parity’ and ‘modified parity’ in pension fixation.

h) Sixth CPC and Seventh CPC also granted parity to the old pensioners.

Let us remember these while observing Pensioners Day on 17-12-2018. Let us pay our homage to late Shri D S Nakara (some people write as Nakra, which is not correct) and late Shri H D Shourie and also to the eminent Judges.
